Mr. Sauer (Attorney for Petitioner, Donald J. Trump:
I wish to pose a different hypothetical to you now concerning this issue of immunity. If the current President, Joe Biden, determined that the Supreme Court has become such a corrupt institution that he went on social media and, in a video, asked his supporters to save the country by marching to the Supreme Court to stop them from conducting their hearing on this matter because they are slowing down the wheels of justice and because they contain at least three Justices that are clearly corrupt.
He notes, first of all, that accused rapist, Brett Kavanaugh has been accused by multiple women of rape. That after Christine Blasey Ford testified against him in his confirmation hearing for Associate Justice, she and her family including school-age children had to leave their house and eventually the house they moved to in order to get away from domestic terrorists who support former President Trump. The Senate limited any investigation of the allegations she made in the hearing to a period of 3 days in order to secure votes from Senators such as Maine Senator Susan Collins. Accordingly, no adequate investigation was conducted to gain information about the his alleged rape. Other women have also made similar allegations about him. When Kavanaugh made remarks to the Senate Judiciary Committee he conducted himself in a fashion, in responding to Senators’ questions (or at least the Democratic ones) which would have warranted he be held in contempt because of the disrespect he exhibited.
Samuel Alito stated under oath in his confirmation hearing for the Associate Justice position that he was not opposed to the basic holding in the case of Roe v. Wade. When asked what he had told his associates at the Department of Justice when he worked there during the Reagan Administration, he said that he wanted them to believe he did oppose that case only because he figured that most of them shared this view, basically conceding he had no problem lying to his colleagues at his workplace (the DOJ) when they may have cases that involve abortion.
Subsequently, he received gifts from parties who had business before the court.
And finally Biden points out that Justice Clarence Thomas not only received trips and gifts from Harlan Crow, a wealthy real estate developer and GOP donor, but also received payments to pay for his nephew’s education and buy his mom’s house. His wife, a political activist, wrote letters to Mark Meadows , former White House Chief of Staff falsely accusing Biden of stealing the 2020 election and demanding he be locked up without trial at Guantanamo Bay detention facility. Nevertheless, Thomas will not recuse himself from the case.
The Chief Justice has refused to allow any outside tribunal to decide if members of the Supreme Court have violated ethics rules. Accordingly…..
Biden concludes by saying this Court has become a threat to our democracy and without action “we’re gonna lose our country. If he demanded the mob go and “fight like hell” to save this country and during the subsequent fight at the Supreme Court building, the protestors, bearing pro-Biden signs and T-shirts kill 5 police officers (although one protestor wielding an An American flag was killed by a security member who was under attack from the masses). Would he be immunized from prosecution for sending that mob to the Court to stop a judicial hearing from taking place?
